When Kentucky’s medical cannabis program launched, patients could qualify with one of seven conditions:
- Cancer
- Chronic or severe pain
- Epilepsy or another seizure disorder
- Multiple sclerosis (MS)
- Muscle spasms or spasticity
- Chronic nausea or cyclical vomiting syndrome that hasn’t responded to other treatments
- Post-traumatic stress disorder (PTSD)
A June 2026 emergency regulation widened that list. Under it, other conditions can also qualify if their symptoms match one of the original seven, as long as a medical cannabis practitioner makes or confirms the diagnosis. The regulation gives 15 examples:
- Terminal illness
- Sickle cell anemia
- Amyotrophic lateral sclerosis (ALS)
- Parkinson’s disease
- Human immunodeficiency virus (HIV)
- Acquired immunodeficiency syndrome (AIDS)
- Huntington’s disease
- Muscular dystrophy
- Cachexia or wasting syndrome
- Crohn’s disease
- Ulcerative colitis
- Neuropathies
- Severe arthritis

How have Kentucky’s medical cannabis laws changed?
Kentucky’s medical program is new. SB 47 legalized medical cannabis in 2023, and the program took effect on January 1, 2025.
- Out-of-state pardon (2022): An executive order offered a conditional pardon for possessing medical cannabis bought legally in another state, for patients with certain conditions and a provider’s certification.
- SB 47 (2023): The law created the medical cannabis program, set the first list of qualifying conditions, and banned smoking.
- HB 829 (2024): Lawmakers created the Office of Medical Cannabis, set rules for when local governments can ban cannabis businesses, and banned vaping cannabis in public places.
- More qualifying conditions (2026): At the governor’s direction, a June 2026 emergency regulation recognized 15 more conditions, including ALS, Crohn’s disease, fibromyalgia, and glaucoma.
- Pardon ended (2026): A new executive order ended the 2022 pardon on July 1, 2026, so patients should buy from Kentucky dispensaries.
- Hemp rules: Intoxicating hemp products like delta-8 can’t be sold to anyone under 21, and Kentucky caps hemp-derived THC drinks at 5 mg per 12-ounce serving.
How much does a Kentucky medical marijuana card cost?
Getting your Kentucky medical card comes down to two costs: your evaluation and your state registry fee.

FAQs About Medical Cannabis in Kentucky
To get a medical marijuana card in Kentucky, you must be a Kentucky resident with a qualifying medical condition and no disqualifying criminal offense. Here’s how to apply for the Kentucky medical cannabis program:
- Book your evaluation. Under SB 47, you need a written certification from a medicinal cannabis practitioner, and Kentucky requires your first evaluation to be in person.
